Frequently Asked Questions

Find clear answers to common questions about buying, selling, and navigating the Kenyan real estate market.

Yes, with one significant limit. Non-citizens cannot own freehold land or agricultural land. They can hold leasehold title for up to 99 years, which covers most apartments and many developments. Kenyan citizens, including dual nationals, can own freehold. If you’re buying as a foreign national, get this confirmed by an advocate before paying a deposit.

Conduct an official search at the lands registry — it shows the registered owner and any charges or caveats. Then have a licensed surveyor confirm the beacons match the title. Never rely on a copy the seller provides. We arrange both as standard on every transaction.

Stamp duty, legal fees, and registration costs. Stamp duty is charged as a percentage of value and differs between urban and rural land; advocate fees follow a published scale. Budget meaningfully above the asking price and get exact figures from your advocate for your specific purchase.

Typically two to three months from offer to transfer, assuming clean title and no financing. Off-plan purchases run to the developer’s handover schedule instead.
